يتابع مركز الرافدين الدولي للعدالة وحقوق الإنسان في جنيف
بقلق بالغ وتصاعد خطير ما يتم تداوله من معلومات وتقارير حول اكتشاف مقابر جماعية جديدة في منطقة الصقلاوية والتي تمثل امتدادًا لأحد أخطر وأكبر ملفات الانتهاكات الإنسانية في العراق والمتمثل بجرائم الإخفاء القسري والتغييب الجماعي والاختطاف خارج إطار القانون منذ عام 2003.
إن هذا الملف لم يعد قضية محلية أو حادثة معزولة بل تحول إلى جريمة إنسانية مستمرة تمس عشرات الآلاف من العائلات العراقية التي ما زالت تجهل مصير أبنائها منذ سنوات طويلة وسط صمت رسمي خطير وعجز واضح عن كشف الحقيقة ومحاسبة المسؤولين عن هذه الجرائم رغم مرور أعوام على اختفاء آلاف المدنيين خلال العمليات العسكرية والنزاعات التي شهدتها المحافظات العراقية.
ويؤكد المركز أن أي تعامل سياسي أو إعلامي محدود مع ملف المقابر الجماعية يمثل إهانة مباشرة لكرامة الضحايا واستخفافًا بحقوق ذويهم خصوصًا أن العديد من مواقع الدفن الجماعي ما زالت مجهولة وأن آلاف العائلات ما زالت تبحث عن أبنائها بين السجون والمعتقلات والمقابر دون أي إجابات رسمية واضحة أو إجراءات جدية لكشف الحقيقة.
وانطلاقًا من المسؤولية القانونية والإنسانية والأخلاقية فإن مركز الرافدين الدولي للعدالة وحقوق الإنسان يطالب بما يلي:
أولًا
تشكيل لجنة تحقيق دولية مستقلة بإشراف أممي مباشر وفعّال تضم خبراء متخصصين في:
الطب العدلي
تحليل الحمض النووي DNA
توثيق جرائم الإخفاء القسري
القانون الجنائي الدولي
حقوق الإنسان
التحقيق في المقابر الجماعية وحفظ الأدلة الجنائية
ثانيًا
فتح جميع مواقع المقابر الجماعية المشتبه بها في محافظات الأنبار وصلاح الدين ونينوى وديالى وبغداد وكشف نتائج التحقيقات للرأي العام بشفافية كاملة بعيدًا عن الضغوط السياسية أو الأمنية.
ثالثًا
إنشاء قاعدة بيانات وطنية مستقلة وشاملة للمفقودين والمغيبين قسرًا تتضمن:
أسماء المفقودين
أماكن وتواريخ الاختفاء
بيانات الشهود
عينات DNA من عائلات الضحايا
نتائج مطابقة الرفات المكتشفة
رابعًا
دعوة International Commission on Missing Persons للمشاركة المباشرة في عمليات الفحص والتوثيق والمطابقة وفق المعايير الدولية المعتمدة.
خامسًا
حماية مواقع المقابر الجماعية باعتبارها مواقع جرائم محتملة ومنع العبث بالأدلة أو نقل الرفات قبل استكمال عمليات التوثيق والفحص الجنائي والقضائي الكامل.
سادسًا
فتح تحقيق مستقل وشامل في جميع ملفات الإخفاء القسري والانتهاكات التي رافقت العمليات العسكرية ومحاسبة جميع المتورطين مهما كانت مواقعهم السياسية أو العسكرية أو المسلحة.
سابعًا
دعوة United Nations Assistance Mission for Iraq وOffice of the United Nations High Commissioner for Human Rights إلى إرسال فرق مراقبة وتحقيق وتوثيق ميداني مستقلة لمتابعة الملف بشكل مباشر.
ثامنًا
الكشف الفوري عن مصير آلاف المغيبين والمعتقلين والسجون السرية وأماكن الاحتجاز غير المعلنة وتمكين ذوي الضحايا من الوصول إلى المعلومات المتعلقة بأبنائهم.
تاسعًا
وقف تنفيذ أحكام الإعدام مؤقتًا إلى حين مراجعة ملفات المعتقلين وضمان معايير المحاكمة العادلة ومنع التعذيب وانتزاع الاعترافات تحت الإكراه.
عاشرًا
مطالبة القوى السياسية كافة وخاصة الشخصيات التي تدّعي تمثيل المحافظات المتضررة بتحمل مسؤولياتها الوطنية والأخلاقية تجاه ملف المغيبين وعدم تحويل معاناة الضحايا إلى مادة للمساومات السياسية أو الانتخابية.
إن المركز يؤكد أن جرائم الإخفاء القسري والمقابر الجماعية والانتهاكات المرتبطة بها لا تسقط بالتقادم وأن حق العائلات في معرفة الحقيقة يمثل حقًا قانونيًا وإنسانيًا أصيلًا تكفله المواثيق الدولية والقانون الدولي الإنساني.
كما يحذر المركز من أي محاولة لإغلاق هذا الملف دون تحقيق دولي حقيقي وشفاف أو محاولة طمس الأدلة وإخفاء الحقائق لأن ذلك سيكرّس ثقافة الإفلات من العقاب ويهدد السلم المجتمعي ومستقبل العدالة في العراق.
ويدعو المركز جميع المنظمات الحقوقية والإنسانية والإعلام الحر والنخب الوطنية العراقية إلى توحيد الجهود من أجل كشف الحقيقة وإنصاف الضحايا وحماية ما تبقى من فرص العدالة.

Urgent Human Rights Statement
Regarding the Mass Graves in Saqlawiyah and the File of Kidnapped and Forcibly Disappeared Persons in Iraq
The alrafidain.info
in Geneva is following with grave concern and growing alarm the circulating reports and information regarding the discovery of new mass graves in Saqlawiyah which represent an extension of one of the most dangerous and largest human rights violation files in Iraq namely the crimes of enforced disappearance collective abduction and unlawful detention outside the framework of the law since 2003.
This file is no longer a local issue or an isolated incident. It has become an ongoing humanitarian crime affecting tens of thousands of Iraqi families who still do not know the fate of their sons and relatives after many years amid dangerous official silence and a clear failure to reveal the truth and hold perpetrators accountable despite the disappearance of thousands of civilians during military operations and armed conflicts in several Iraqi provinces.
The Center affirms that any limited political or media handling of the mass graves file constitutes a direct insult to the dignity of the victims and a disregard for the rights of their families especially as many burial sites remain unknown while thousands of families continue searching for their loved ones among prisons detention centers and graves without receiving any clear official answers or genuine investigative efforts.
Based on legal humanitarian and moral responsibility the Al-Rafidain International Center for Justice and Human Rights calls for the following:
First
The establishment of an independent international investigation commission under direct and effective United Nations supervision including experts in:
Forensic medicine
DNA analysis
Documentation of enforced disappearances
International criminal law
Human rights
Investigation of mass graves and preservation of criminal evidence
Second
The opening of all suspected mass grave sites in Al-Anbar Salah al-Din Nineveh Diyala and Baghdad and the transparent disclosure of investigation results to the public free from political or security pressure.
Third
The creation of an independent and comprehensive national database for missing and forcibly disappeared persons including:
Names of the missing persons
Locations and dates of disappearance
Witness testimonies
DNA samples from victims’ families
Results of forensic matching of discovered remains
Fourth
Calling upon International Commission on Missing Persons to directly participate in examination documentation and identification procedures in accordance with internationally recognized standards.
Fifth
The protection of mass grave sites as potential crime scenes and preventing any tampering with evidence or transfer of remains before the completion of full forensic judicial and criminal documentation procedures.
Sixth
The opening of a comprehensive and independent investigation into all enforced disappearance cases and violations associated with military operations and ensuring accountability for all perpetrators regardless of their political military or armed affiliation.
Seventh
Calling upon United Nations Assistance Mission for Iraq and Office of the United Nations High Commissioner for Human Rights to dispatch independent monitoring investigation and field documentation teams to directly follow this file.
Eighth
The immediate disclosure of the fate of thousands of disappeared detainees secret prisons and undeclared detention facilities and enabling victims’ families to access information concerning their relatives.
Ninth
The temporary suspension of executions until all detainees’ cases are reviewed and guarantees of fair trial standards prevention of torture and prohibition of forced confessions are ensured.
Tenth
Calling on all political forces especially individuals claiming to represent the affected provinces to assume their national and moral responsibilities regarding the file of the disappeared and to refrain from exploiting victims’ suffering for political or electoral bargaining.
The Center stresses that crimes of enforced disappearance mass graves and related violations are not subject to statutes of limitations and that the right of families to know the truth is a fundamental legal and humanitarian right guaranteed under international conventions and international humanitarian law.
The Center also warns against any attempt to close this file without a genuine transparent and international investigation or any effort to conceal evidence and obscure facts because such actions would reinforce the culture of impunity and threaten social peace and the future of justice in Iraq.
The Center calls upon all human rights organizations humanitarian bodies free media outlets and Iraqi national figures to unite efforts in order to uncover the truth achieve justice for the victims and preserve what remains of hope for accountability and justice in Iraq.
