في سابقة خطيرة تعكس حجم الانهيار في منظومة العدالة العراقية، اعترف المدعو أحمد حمداوي عويد معارج الكناني، بارتكابه جريمة اغتيال الإعلامي والباحث البارز هشام الهاشمي بتاريخ 16 يوليو/تموز 2021.
وقد أدلى المتهم باعتراف صريح، أكد فيه أن عملية التصفية جاءت بأوامر مباشرة من النائب الحالي في البرلمان العراقي، المدعو “حسين مؤنس”، الذي يشغل في الوقت ذاته منصب مسؤول الأمن في ميليشيا كتائب حزب الله، إحدى أبرز الجماعات المسلحة الموالية لإيران داخل العراق.
رغم وضوح الاعترافات، لم تُتخذ حتى الآن أي إجراءات قضائية بحق الجهة التي أصدرت الأمر بالجريمة، بل ما زال المتورط يتمتع بالحصانة البرلمانية ويتحرك بحرية، في ظل صمت مريب من السلطات القضائية والتنفيذية، وهو ما يثبت بما لا يدع مجالاً للشك، أن القضاء العراقي بات خاضعاً بشكل كامل لهيمنة المليشيات المسلحة، وفاقداً لاستقلاله ووظيفته الأساسية في تحقيق العدالة.
إننا في مركز الرافدين الدولي للعدالة وحقوق الإنسان، نناشد المجتمع الدولي، ومنظمات الأمم المتحدة، ومجلس حقوق الإنسان، والجهات المعنية بحرية الرأي وسلامة الصحفيين، بضرورة التدخل العاجل لفتح تحقيق دولي مستقل في جريمة اغتيال هشام الهاشمي، ومحاسبة جميع المسؤولين عنها، بمن فيهم من أصدر الأمر ونفذه وغطى عليه قضائياً.
كما نطالب بتفعيل الآليات الدولية لحماية المدافعين عن حقوق الإنسان والإعلاميين في العراق، ومساءلة الحكومة العراقية عن تقاعسها المتعمد في مواجهة نفوذ المليشيات، الذي يشكل تهديداً جسيماً لسيادة الدولة وحقوق مواطنيها.

Urgent Statement: The Politicized Iraqi Judiciary Conceals Militia Crimes
Date: 7 July 2025
In a dangerous precedent that reveals the extent of the collapse of the justice system in Iraq, Ahmad Hamdawi Owaid Ma’arij Al-Kinani confessed to the assassination of prominent journalist and researcher Hisham Al-Hashimi on July 16, 2021.
In his clear confession, the perpetrator stated that the order to carry out the assassination came directly from the current member of the Iraqi parliament, Mr. Hussein Moanes, who also serves as the Security Chief of Kata’ib Hezbollah, one of the most prominent Iran-backed militias operating in Iraq.
Despite the clarity of these confessions, no legal action has been taken so far against those who issued the assassination order. The implicated official still enjoys parliamentary immunity and moves freely, under suspicious silence from both judicial and executive authorities. This confirms beyond doubt that the Iraqi judiciary is under the complete control of armed militias and has lost its independence and core function of upholding justice.
We at the Rafidain International Center for Justice and Human Rights urgently call on the international community, United Nations agencies, the Human Rights Council, and organizations concerned with freedom of the press and journalist protection, to intervene immediately and launch an independent international investigation into the assassination of Hisham Al-Hashimi. All those responsible—those who ordered, carried out, and covered up the crime—must be held accountable.
We further call for the activation of international mechanisms to protect human rights defenders and journalists in Iraq, and for holding the Iraqi government accountable for its deliberate failure to confront militia influence, which poses a serious threat to state sovereignty and the rights of its citizens.
